LALA “SIEMPRE A TU LADO” CONTEST
OFFICIAL RULES - NO PURCHASE NECESSARY. A PURCHASE DOES NOT INCREASE CHANCES OF WINNING. VOID WHERE PROHIBITED. CONTEST INTENDED FOR PARTICIPATION IN
THE CONTINENTAL UNITED STATES ONLY.
1) ELIGIBILITY: The Contest is only open to legal residents of the continental United States, who are 18 years of age or older as of October 3, 2008. Employees (including, without limitation, part-time or temporary employees) of LALA (the “Sponsor”), Directo Hispanic, Don Jagoda Associates, Inc., their respective parent companies, subsidiaries, affiliates, and the directors, officers, or agencies, any of their respective partners (collectively, the “Sponsor Affiliates”) or any of the members of their immediate family (defined as spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren, roommates, housemates, significant others, partners) or same household of each are not eligible to participate. This Contest is void outside of the continental United States and where prohibited or restricted by law and is subject to all applicable federal, state and local laws.
2) HERE’S HOW TO ENTER: There are five ways to enter the LALA “Siempre a tu Lado” Contest (the “Contest”), beginning 12:00:01 AM ET October 3, 2008 and ending 11:59:59 PM ET December 23, 2008 (“Contest Period”).
(1) ONLINE ESSAY: During the Contest Period, entrants may enter by visiting the entry section at www.lalafoods.com or www.lalasiempreatulado.com (“Entry Site”) and completing all information requested on the entry form and writing an original essay (in English or Spanish) up to 150 words in the text box portion of the entry form, describing what their dream is and what would they do with the $10,000 as well as how LALA has been by their side and can help them make their dream a reality and clicking on the “submit” button to complete the entry process. In order to be entered into the Contest, entrants must comply with all registration instructions. Essays must not exceed 150 words, or entry will be disqualified. The submission may not contain obscene, lewd or inappropriate text, as determined in Sponsor’s sole discretion. Limit one entry per person, regardless of method of entry. Multiple entries will be disregarded.
(2) ONLINE VIDEO: During the Contest Period, entrants may enter by visiting the entry section at www.lalafoods.com or www.lalasiempreatulado.com (“Entry Site”) and completing all information requested on the entry form and uploading an original video (maximum 60 seconds long) that describes what their dream is and what would they do with the $25,000 as well as how LALA has been by their side and can help them make their dream a reality and clicking on the “submit” button to complete the entry process. In order to be entered into the Contest, entrants must comply with registration instructions and specifics for uploading the video. The online video entry must: 1) be complete to be eligible; 2) include a video; 3) video must be the property of the entrant, be non-professional and, 4) be uploaded in accordance with the specifications set forth at the WebSite. Any video deemed inappropriate, in Sponsor’s sole discretion, will be disqualified. Entry material may be disqualified if the material or portion thereof, in the Sponsor’s sole discretion, contains one or more of the following: obscenity, profanity, or content that is deemed lewd, offensive, explicit, vulgar, crude, or defamatory; any content unsuitable for broadcast; materials that are violent or display illegal drug or alcohol use; any use of commercial products or services, including any use of trademarks, brands or logos of commercial products (except Sponsors’ products) and services, such as the marks or logo of the Sponsor; information that can be used to personally identify an individual, such as an address, phone number or email address; any other person or likeness of another person, living or deceased; material that is derogatory or threatening to any person or group of people; any third party materials (including but not limited to music), that otherwise violates or infringes (or may infringe) any copyright, trademark, logo, mark that identifies a brand (except Sponsor’s), or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity; materials (other than Sponsors’ products) or content that have been submitted for another contest or published or disseminated in any other way by the participant or anyone else. Any entry not in compliance with the above and that does not meet the Contest requirements will be disqualified. In such an event, the video will be disqualified from the Contest. Limit one entry per person, regardless of method of entry. Multiple entries will be disregarded.
(3) TAPE VIDEO AT A MOBILE TOUR STOP: During the Contest Period, entrants may enter by going to one of the LALA mobile tour stops (check www.lalafoods.com or www.lalasiempreatulado.com for a list of locations, dates and times) and completing all information requested on the entry form and having one of the LALA representatives tape a video of the entrant in which the entrant describes what their dream is and what would they do with the $25,000 as well as how LALA has been by their side and can help them make their dream a reality (maximum 60 seconds long). If for any reason out of the Sponsor’s control the LALA mobile tour is not able to appear at a location indicated at the Entry Site the Sponsor will assign a different location and post it on the Entry Site. Any video deemed inappropriate, in Sponsor’s sole discretion, will be disqualified. Entry material may be disqualified if the material or portion thereof, in the Sponsor’s sole discretion, contains one or more of the following: obscenity, profanity, or content that is deemed lewd, offensive, explicit, vulgar, crude, or defamatory; any content unsuitable for broadcast; materials that are violent or display illegal drug or alcohol use; any use of commercial products or services, including any use of trademarks, brands or logos of commercial products (except Sponsors’ products) and services, such as the marks or logo of the Sponsor; information that can be used to personally identify an individual, such as an address, phone number or email address; any other person or likeness of another person, living or deceased; material that is derogatory or threatening to any person or group of people; any third party materials (including but not limited to music), that otherwise violates or infringes (or may infringe) any copyright, trademark, logo, mark that identifies a brand (except Sponsor’s), or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity; materials (other than Sponsors’ products) or content that have been submitted for another contest or published or disseminated in any other way by the participant or anyone else. Any entry not in compliance with the above and that does not meet the Contest requirements will be disqualified. In such an event, the video will be disqualified from the Contest. Limit one entry per person, regardless of method of entry. Multiple entries will be disregarded.
(4) MAIL-IN ESSAY: During the Contest Period, entrants may enter by mail, by sending an original essay (in English or Spanish) up to 150 words, in which they describe what their dream is and what would they do with the $10,000 as well as how LALA has been by their side and can help them make their dream a reality. The essay must be typed or neatly hand printed on an Official Entry Form found in the samplers located at participating retail stores or on a plain 8½” X 11” piece of paper (entries received on anything other than an Official Entry Form or an 8½” X 11” piece of paper will be void). Each entrant must also include the following information on the top of his/her entry: 1.) Complete name, complete address, daytime telephone number (including area code) and age; and 2.) Word Count: entrants must indicate the total number of words in the essay. All words must be counted, including “I”, “a”, etc. Each entrant must mail the entry in a stamped envelope to: LALA “Siempre a tu Lado” Contest Entry, PO Box 91990, Pasadena, CA 91109-1990. Entries must be postmarked by December 23, 2008 and received by December 30, 2008. Neither Sponsor, nor the Sponsor Affiliates are responsible for lost, late, damaged, delayed, destroyed, misdirected, incomplete, illegible or mutilated entries. Limit one entry per person, regardless of method of entry. Multiple entries will be disregarded.
(5) MAIL-IN VIDEO: During the Contest Period, entrants may enter by mail, by sending an original video (maximum 60 seconds long) in which they describe what their dream is and what would they do with the $25,000 as well as how LALA has been by their side and can help them make their dream a reality . Only VHS tapes or DVDs will be accepted. Each entrant must also include the following information: Complete name, complete address, daytime telephone number (including area code) and age. Each entrant must mail the entry in a stamped envelope to: LALA “Siempre a tu Lado” Contest Entry, PO Box 91990, Pasadena, CA 91109-1990. Entries must be postmarked by December 23, 2008 and received by December 30, 2008. Any video deemed inappropriate, in Sponsor’s sole discretion, will be disqualified. 3. VIDEO GRAND PRIZE AND APPROXIMATE RETAIL VALUE (“ARV”): One (1) Video Grand Prize: A three (3) day/two (2) night trip for two (2) to Los Angeles, California to attend the award ceremony where Eduardo Verastegui (subject to availability) will personally award the Video Grand Prize Winner a check for $25,000 (trip ARV is up to $2,040). Trip includes round-trip coach air transportation from the major airport nearest to the winner’s home to Los Angeles, California, round-trip transfers from the airport to the hotel and return, accommodations at a Sponsor specified hotel, based on double occupancy, and a $240 check for winner for meal allowance. Total approximate value of the Video Grand Prize is $27,040. Trip must be taken on date to be determined by Sponsor or prize will be forfeited. In the event the award ceremony in Los Angeles, California is cancelled due to circumstances beyond the Sponsor’s control, the winner would receive the check for $25,000 and trip portion of the prize, but the award ceremony will not be awarded and no additional compensation will be provided.
4. VIDEO FIRST PRIZE: One (1) Video First Prize: A check for $2,500 that will help improve the winner’s quality of life.
5. 6. ESSAY FIRST PRIZE: One (1) Essay First Prize: A check for $2,500 that will help improve the winner’s quality of life.
7. JUDGING: Round One: All Entries (regardless of entry method) will be verified and screened for compliance with the Official Rules by Don Jagoda Associates, Inc., an independent judging organization. All eligible Entries will then be judged by Don Jagoda Associates, Inc., whose decisions are final, on or about January 5, 2009, to determine 20 Finalists from the Video Entries and 20 Finalists from the Essay Entries. The Video Entries will be judged based on the following Video judging criteria: Originality (40%); Truthfulness (30%); Relevance to Theme (20%); and Video Quality (10%). The Essay Entries will be judged based on the following Essay judging criteria: Originality (40%), Truthfulness (30%), and Relevance to Theme (20%) and Legibility (10%). Entries that do not meet the criteria enumerated in Rule #2 above (in Judges’ sole discretion) are not eligible. Round Two: The 20 Finalists from the Video Entries and the 20 finalist from the Essay Entries will then be re-judged by a panel of judges determined by the Sponsor, whose decisions are final, on or about January 8, 2009, to determine the 2 Prize winners from the Video Entries based on the same Video judging criteria listed above and the 2 Prize winners from the Essay Entries based on the same Essay judging criteria listed above.
8. WINNER NOTIFICATION: The potential Grand and First Prize Video and Essay winners will be notified by phone and/or mail and will be required to complete, sign and return, a notarized Affidavit of Eligibility/Release of Liability and, where legal, Publicity Release. The potential winners are required to return the document within 4 days from the postmark date on the prize notification letter or prize may be forfeited and an alternate winner selected. Winners are responsible for any and all federal, state and local taxes.
9. PRIZE RESTRICTIONS: The Grand Prize Video and Essay winners and their respective travel companions must travel together on the same itinerary and must have valid travel documents (i.e., valid photo ID) prior to departure. Grand Prize Video and Essay Winners’ travel companions (or parent/legal guardian if a travel companion is a minor) must execute a Release of Liability prior to departure. Airline carrier’s regulations and conditions apply. Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Trip must be taken on dates specified by the Sponsor. If a Grand Prize Video or Essay winner is unable to travel on dates indicated, his/her prize may be forfeited. Certain additional restrictions may apply. Seat selection and timing of trip subject to availability and confirmations of reservations. All other expenses and costs, not expressly listed above, including, but not limited to, taxes, tips, and entertainment are the winners’ sole responsibility.
10. GENERAL RULES: The Sponsor will make 3 attempts to contact the potential winners within 48 hours from the time winner selection was accomplished. If Sponsor is unable to reach the potential winners within this time frame, he/she will be disqualified and an alternate will be selected. Affidavit package will be sent via UPS overnight with pre-paid UPS overnight return envelope. All entries must be the sole, original work of the Entrants. Judges may disqualify previously published essays or essays/videos that have won previous awards or competitions. Entries become the property of the Sponsor and will not be acknowledged or returned. Automated, script, macro or robotic entries submitted by individuals or organizations (either by mail or online) will be disqualified. Normal Internet access and usage charges imposed by entrants’ online service will apply. Entrants and winners acknowledge and agree that their entries become the property of the Sponsor, which thereby has the right to edit, adapt, modify, reproduce, promote and otherwise use entries in any way they see fit. No information regarding entries or judging, other than as otherwise set forth in the Official Rules will be disclosed. Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Contest; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. In the event this Contest is compromised in any way, the Sponsor reserves the right to cancel, terminate, or suspend the Contest and in such event, to select the winners from among all eligible entries received, up to such time of cancellation, termination or suspension. Entrants agree to be bound by these Official Rules and the decisions of the judges. All aspects of the prizes are non-transferable and no substitutions or cash equivalents are allowed except at the Sponsor’s sole discretion. Winners agree to indemnify and hold harmless and waive any and all claims of liability of any kind whatsoever against the Sponsor and/or the Sponsor Affiliates including any accident, loss, injury or death occurring or in any way related to the prize or use/misuse thereof or while traveling to and/or from a location to obtain or use a prize. Neither the Sponsor nor the Sponsor Affiliates make any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the use of prize including, without limitation, quality, merchantability, and fitness for a particular purpose. Winners, in accepting their prize and entrants, consent to the use of their names and entries, address (city, state), photograph, videos, essays and likeness for purposes of advertising, trade and promoting in any and all media on behalf of the Sponsor, including, without limitation, posting on Sponsor’s web site, without further compensation, except where prohibited by law.
11. GOVERNING LAW & VENUE: The California Courts (State & Federal) shall have sole jurisdiction of any controversies regarding the contest and the laws of the state of California shall govern the same. Each contest entrant waives any and all objections to jurisdiction and hereby irrevocably submits to the venue of those courts within the county of Los Angeles, California.
12. WINNERS: To receive a winners list, mail a self-addressed, stamped envelope, by March 2, 2009, to: LALA “Siempre a tu Lado” Contest Winners, 11 Golden Shore, Suite 560, Long Beach, CA 90802.
